The right to ‘domestic remedies’, which ideally connects ‘subsidiarity’ and ‘embeddedness’ of the ECHR in the legal systems of member States, is deemed to play a crucial role for the Strasbourg machinery survival as well as for an effective protection of human rights, especially in the field of the ‘reasonable-time’ requirement. In this respect the Italian case seems an excellent test. Once a compensatory remedy was introduced in the Italian legal system by Law No. 80 of 2001 (the ‘Pinto Act’), (...) it soon appeared that such a remedy could be considered ‘effective’ in so far as it was implemented in accordance with the ECtHR’s jurisprudence. Therefore a legal tool for the interaction between ECtHR and Italian courts had to be found. Nevertheless, the results of this interaction might suggest that the domestic remedy has neither increased the protection of the reasonable-time requirement in Italy nor is it the final solution to the ECtHR’s overload. Summary Habituation mechanisms play a pivotal role in enabling organisms to filter out irrelevant stimuli and concentrate on essential ones. Through repeated exposure, the brain learns to disregard stimuli that are irrelevant, effectively ceasing to respond to potentially distracting input. Previous studies have demonstrated that the orienting response to visual distractors disrupting visual detection tasks habituates as tasks progress and distractors are encountered repeatedly, as their initial interference diminishes. Theoretical models posit that this reduction is contingent upon the establishment of (...) an internal representation of external stimuli. Moreover, further studies have indicated that habituation can be context- specific, suggesting that the mechanisms involved incorporate information about features of irrelevant stimuli that extend beyond their discrete characteristics. In this contribution, we further delved into the question of whether the context in which habituation occurs retains a general habituative capacity when a new, to-be-ignored stimulus is introduced. We discuss evidence indicating that the context in which habituation has already taken place facilitates the habituation process for a new stimulus. This suggests that it becomes easier to ignore new stimuli in contexts where we have already learned to disregard other stimuli, underscoring the intricate interplay between habituation, context, and attentional processes. ABSTRACT The article aims to examine the behavior of contemporary speech genre theory in the analysis of Pauline epistles. The genre of letters is conceived within its original communicative purpose, limited to sender and receivers, whereas the epistle refers to the letter read outside of its original context, considered as literature. The research corpus is composed of the Corinthian epistles of the New Testament, which are accepted as authored by the Apostle Paul. They are selected due to their shared audience, (...) enabling a comparison of production context aspects in the apostle’s writings over time. Research findings include: letters that acquire new meanings, when transformed into epistles with a broader readership; the epistle genre, despite undergoing significant modifications, remains recognizable to present-day readers due to its macrostructure; the social role and communicative intent of the sender that result in alternating usage of formal and informal language, as well as variations in discourse person. One hundred years ago, Frederick Taylor and the pioneers of scientific management went into battle on US factory-floors. Armed with stopwatches and clipboards, they were fighting a war over measure. A century on and capitalist production has spread far beyond the factory walls and the confines of 'national economies'. Although capitalism increasingly seems to rely on 'cognitive' and 'immaterial' forms of labour and social cooperation, the war over measure continues. Armies of economists, statisticians, management-scientists, information-specialists, accountants and others are engaged (...) in a struggle to connect heterogeneous concrete human activities on the basis of equal quantities of human labour in the abstract – that is, to link work and capitalist value. In this paper, we discuss contemporary capital's attempt to impose the 'law of value' through its measuring of immaterial labour. Using the example of higher education in the UK – a 'frontline' of capitalist development – as our case-study, we explain how measuring takes places on various 'self-similar' levels of social organisation. We suggest that such processes are both diachronic and synchronic: socially-necessary labour-times of 'immaterial doings' are emerging and being driven down at the same time as heterogeneous concrete activities are being made commensurable. Alongside more overt attacks on academic freedom, it is in this way that neoliberalism appears on campus. (shrink)

The COVID-19 pandemic is a health issue leading older adults to an increased vulnerability to unfavorable outcomes. Indeed, the presence of physical frailty has recently led to higher mortality due to SARS-CoV-2 infection. However, no longitudinal studies have investigated the role of neuropsychogeriatric factors associated with lockdown fatigue in healthy cognitive aging. Eighty-one healthy older adults were evaluated for their neuropsychological characteristics, including physical frailty, before the pandemic. Subsequently, 50 of them agreed to be interviewed and neuropsychologically re-assessed during the (...) lockdown and immediately after it. Moreover, during another home confinement, they performed a psychological screening to evaluate possible mood changes and fatigue. According to Fried's frailty criteria, at T0, 63% of the sample was robust, 34.5% pre-frail, and only 2.5% frail. Significantly, these subjects presented a decrease in handgrip strength and walking speed. Results from Principal Component Analyses and multiple regression models highlighted the contribution of “cognitive” and “psychological” factors in explaining handgrip strength and gait speed. At T3, lockdown fatigue was explained by higher scores on the Beck Depression Inventory and lower scores on the Trail Making Test part A. Results from a moderated-mediation model showed that the effect of psychomotor speed on lockdown fatigue was mediated by depression, with a moderating effect of gait speed. Our findings highlight the complex interrelationship between cognitive, psychological, and physical factors in the emergence of pandemic fatigue in a carefully selected older population. (shrink)

The article is by Nathan Cofnas and is entitled “Research on group differences in intelligence: A defense of free inquiry” (2020). The purpose of our letter is not to invite Cofnas’s contribution into a broader dialogue, but to respectfully voice our concerns about the decision to publish the manuscript, which, in our opinion, fails to (...) meet a range of academic quality standards usually expected of academic publications. This article proposes a retrospective analysis of a compassionate use, using a case study of request for Avelumab for a patient suffering from Merkel Cell Carcinoma. The study is the result of a discussion within a Provincial Ethics Committee following the finding of a high number of requests for CU program. The primary objective of the study is to illustrate the specific ethical and clinical profiles that emerge from the compassionate use program issue. The secondary goals are: a) to promote (...) a moral reflection among physicians who require approval for the CUP and b) provide the basis for recommendations on how to request CUP. The instruments for carrying out the analysis of the case study and the discussion are as follows: Analysis of the audio-recording of the EC meeting regarding the selected Case study. In-depth discussion of topics that emerged during the meeting by means of administration of 5 semi-structured interviews with 2 doctors involved in the case and with 3 components of the EC who played a major role in the EC internal discussion. In an exploration of emerging clinical and ethical issues, four primary themes arise: 1. efficacy, safety of the treatment and patient’s quality of life; 2. clear, realistic, adequate communication; 3. right to hope; 4. simultaneous Palliative Care approach. The results of ethical analysis carried out concern two areas: 1) ethical profiles relating to the use of CUP; 2) the role of the EC concerning the compassionate use of drugs and the need to provide recommendations on how to request CUP. With the aim of implementing these conclusions, the provincial EC of Reggio Emilia chose to steer the request for drugs for compassionate use through recommendations for good clinical and ethical practice based on the following assumptions: 1) the “simultaneous care” approach must be preferred. Secondly, 2) the EC’s assessment must be part of the decision-making process that the care team conducts before proposing compassionate use to the patient. (shrink)

This paper distinguishes four senses of naturalism: reductive physicalism; a naturalism that departs from what Thompson calls “natural-historical judgments”; a naturalism that recognizes that physical nature is located within the space of reasons; and a phenomenological naturalism that shifts the focus to the “natural” experiences of subjects who encounter the world. The paper argues for a “phenomenological neo-Aristotelianism” that accounts both for the internal justification of our first-order moral experience and the need for a broader grounding in a universalistic account (...) of the goods of agency. Tales semejanzas, pese a la diferencia de tiempos, de circunstancias y de luces, muestran que la causa del pueblo francés es la de la nación inglesa, y también la de todos los pueblos libres o que han concebido la esperanza de llegar a serlo.

The aim of the study is to rethink the ethics of advanced motherhood. In the literature, delayed childbearing is usually discussed in the context of reproductive justice, and in relationship to ethical issues associated with the use and risk of assisted reproductive technologies. We aim to go beyond these more “traditional” ways in which reproductive ethics is framed by revisiting ethics itself through the lens of the figure of the so-called “older” mother. For this purpose, we start by exploring some (...) of the deep seated socio-cultural discourses in the context of procreation: ageism, ableism and the widespread bias towards geneticism and pronatalism. Afterwards, we provide a critical overview of the key arguments against or in support of advanced motherhood. We then briefly discuss how entrenchment by both sides has produced an impasse in the debate on the ethics of advanced motherhood and proceed by arguing that it is fundamental to bring about a change in this narrative. For this purpose, we will revisit the feminist usage of the concept of vulnerability which will allow us both to criticize culturally prescribed norms about motherhood and to address the painful reality of age-related fertility decline. In the last section, we argue that instead of defining “older” motherhood as an ethical problem, we should problematize the fact that female reproductive ageing is an understudied and ill-sourced topic. We believe that allocating resources to research to better understand female reproductive ageing is not only ethically permissible, but might even be ethically desirable. (shrink)

A startup ecosystem is a dynamic environment in which several actors, such as investors, venture capitalists, angels, and facilitators, are the protagonists of a complex interplay. Most of these interactions involve the flow of capital whose size and direction help to map the intricate system of relationships. This quantity is also considered a good proxy of economic success. Given the complexity of such systems, it would be more desirable to supplement this information with other informative features, and a natural choice (...) is to adopt mathematical measures. In this work, we will specifically consider network centrality measures, borrowed by network theory. In particular, using the largest publicly available dataset for startups, the Crunchbase dataset, we show how centrality measures highlight the importance of particular players, such as angels and accelerators, whose role could be underestimated by focusing on collected funds only. We also provide a quantitative criterion to establish which firms should be considered strategic and rank them. Finally, as funding is a widespread measure for success in economic settings, we investigate to which extent this measure is in agreement with network metrics; the model accurately forecasts which firms will receive the highest funding in future years. This article proposes an original analysis of the international debate on climate change through the use of digital methods. Its originality is twofold. First, it examines a corpus of reports covering 18 years of international climate negotiations, a dataset never explored before through digital techniques. This corpus is particularly interesting because it provides the most consistent and detailed reporting of the negotiations of the United Nations Framework Convention on Climate Change. Second, in this paper we test an original approach to (...) text analysis that combines automatic extractions and manual selection of the key issue-terms. Through this mixed approach, we tried to obtain relevant findings without imposing them on our corpus. The originality of our corpus and of our approach encouraged us to question some of the habits of digital research and confront three common misunderstandings about digital methods that we discuss in the first part of the article. In addition to reflecting on methodology, however, we also wanted to offer some substantial contribution to the understanding of UN-framed climate diplomacy. In the second part of the article we will therefore introduce some of the preliminary results of our analysis. By discussing three visualizations, we will analyze the thematic articulation of the climatic negotiations, the rise and fall of these themes over time and the visibility of different countries in the debate. Sin embargo, aquellos textos marginales, secundarios, en los que la autora ensayaba retratos de grandes hombres y mujeres de su tiempo permanecen, en gran medida, ocultos. En este artículo nos ocupamos de desentrañar la lectura que Arendt (...) realizó del gran poeta de posguerra de lengua alemana: Franz Kafka. Esta relación, transida por el judaísmo, adoptó tres rostros diferentes a lo largo de los muchos años en que la pensadora estuvo escribiendo. La conceptualización que se realiza aquí gira en torno al eje de la gran obra The Origins of Totalitarianism para comprender al paria de buena voluntad, el contemporáneo apolíneo y el pensador del tiempo. : Creativity, mostly ignored in Western philosophy due to its supposed mysteriousness, has recently become a respected research topic in psychology, neuroscience, and artificial intelligence. We discuss how in science the approach has mainly been to describe creativity as an information-based process, coherently with a computational view of the human mind started with the cognitive revolution. This view has produced progressively convincing models of creativity, up to current artificial neural network systems, vaguely inspired by biological neural processing, but already competing (...) with human creativity in several fields. These successes suggest that creativity might not be an exclusively human function, but actually a way of functioning of any natural or artificial system implementing the creative process. We conclude by acknowledging that the information-based view of creativity has tremendous explanatory and generative power, but we propose a thought experiment to start discussing how it actually leaves out the experiential side of being creative. Vogliamo illustrare il modo in cui lo sguardo scientifico sia rivolto prevalentemente a considerare la creatività come processo information-based, coerentemente con la prospettiva computazionale sulla mente umana aperta dalla rivoluzione cognitiva. Questa prospettiva ha prodotto modelli della creatività sempre più convincenti, fino agli attuali sistemi di reti neurali artificiali, vagamente inspirati al processamento biologico neurale, ma già competitivi rispetto alla creatività umana in molti ambiti. Questi successi suggeriscono che la creatività possa non essere una funzione esclusivamente umana ma in effetti un modo di funzionare di un sistema naturale o artificiale capace di implementare il processo creativo. In conclusione, pur riconoscendo come il considerare la creatività come processo information-based possieda grande potere esplicativo e generativo, proporremo un esperimento mentale per aprire una discussione sul come questa prospettiva non copra in effetti il lato esperienziale dell’essere creativo. The study investigated the extent to which defensive functioning and defense mechanisms predict clinically meaningful symptomatic improvement within brief psychodynamic psychotherapy for recurrent and chronic depression in an inpatient setting. Treatment response was defined as a reduction in symptom severity of 46% or higher from the baseline score on the Montgomery–Asberg Depression Rating Scale. A subsample of 41 patients from an RCT was included. For each case, two sessions of brief inpatient psychodynamic psychotherapy were transcribed and then coded using the (...) Defense Mechanism Rating Scales and the Psychotic Defense Mechanism Rating Scales, an additional scale developed to study psychotic defenses. Results showed that defensive functioning and mature and immature defense changed during psychotherapy and predicted treatment response. Patient’s defenses observed throughout therapy also predicted treatment response at 12-month follow-up. The addition of psychotic defenses allows a better prediction of the treatment response. Overall, these results are in line with previous research and provide further validation of defensive functioning as a predictor of outcomes and a mechanism of change in psychotherapy. (shrink)
